Waiver and Release of Liability

The Volunteer desires to provide services as a volunteer for the Dallas Mayor’s Back To School Fair (MBTSF) and engage in the activities related to being a volunteer. Volunteer (or Parent/Legal Guardian of Volunteer if Volunteer is under the age of 18) understands that the scope of Volunteer’s relationship with MBTSF is limited to a volunteer position and that no compensation is expected in return for services provided by Volunteer. The Volunteer does hereby freely, voluntarily, and without duress execute this Waiver and Release of Liability under the following terms:

Waiver and Release. Volunteer does hereby release and forever discharge and hold harmless MBTSF and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Volunteer’s service for MBTSF. Volunteer understands and acknowledges that this Release discharges MBTSF from any liability or claim that the Volunteer may have against MBTSF with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Volunteer’s service for MBTSF.

Medical Treatment. Except as otherwise agreed to by MBTSF in writing, Volunteer does hereby release and forever discharge MBTSF from any claim whatsoever that arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer’s work for MBTSF.

Assumption of the Risk. The Volunteer understands that the work for MBTSF may include a variety of activities including, but not limited to: bending, lifting, walking, carrying, and transporting of supplies.

Insurance. The Volunteer understands that MBTSF does not carry or maintain health, accident, liability (including without limitation motor vehicle liability), property loss or damage (including without limitation motor vehicle collision damage), medical or disability insurance coverage for any Volunteer or the property of any Volunteer. Each Volunteer is expected to obtain his or her own automobile, medical, or health insurance coverage.

Photographic Release. Volunteer does hereby grant and convey unto MBTSF all rights, title and interest in any and all photographic images and video or audio recordings made by MBTSF during the Volunteer’s service for MBTSF, including but not limited to any royalties, proceeds, or other benefits derived from such photographs or recordings.

Dismissal.  Volunteer agrees to adhere to the rules and procedures of the MBTSF.  Volunteer acknowledges that MBTSF has the sole discretion to end the Volunteer’s service for MBTSF at any time, with or without notice.  In particular, Volunteer acknowledges that the Volunteer’s service will be discontinued if Volunteer fails to adhere to the rules and procedures of the MBTSF, including but not limited to the following: being under the influence of drugs or alcohol; theft of property or misuse of MBTSF materials; abuse or mistreatment of clients, staff or other volunteers;  and not satisfactorily performing assigned duties.

Age. According to safety guidelines, all Volunteers must be 8 years of age or older. Parents/Legal guardians are responsible for registering eligible youth. Youth is defined as individuals who are under the age of 18.

Other. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Texas. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

As part of the volunteer requirements, I understand a brief training will be provided virtually prior to event day, and there will be on-site training for my role.
